Summary Probate Administration in Florida

In Florida, summary probate administration is an expedited process for handling smaller estates or those where the decedent has been deceased for more than two years. It is governed by Florida Statutes § 735.201-735.2063 and Florida Probate Rule 5.530. Summary administration allows for the estate to be distributed without the need for a full, formal probate process, making it faster and more cost-effective.

To qualify for summary administration, two key conditions must be met: (1) the value of the estate subject to probate must not exceed $75,000 (excluding exempt property, like homestead), or (2) the decedent must have passed away more than two years ago. Additionally, all creditors must be paid or provided for before assets are distributed. If there are outstanding creditors, a petition for summary administration cannot be granted unless the creditors consent or their claims are satisfied.
